Employment law in Uzbekistan
Employment relations in Uzbekistan underwent a significant reform when the new edition of the Labour Code entered into force on 30 April 2023. The Code updated rules on employment contracts, working time, remote work, termination and employer obligations, and many companies have needed to review their HR documents and practices as a result. When did the new Labour Code of Uzbekistan come into force?
The new edition of the Labour Code entered into force on 30 April 2023. Employers that have not reviewed their employment contracts and internal documents since then should consider doing so.
Can an employment contract with an Uzbek employee be governed by foreign law?
Employment of staff working in Uzbekistan is generally subject to Uzbek labour law, and the guarantees provided by the Labour Code cannot be excluded by agreement. Group templates therefore need to be adapted to local requirements.
Is it possible to terminate an employee by mutual agreement?
Yes, termination by agreement of the parties is permitted under the Labour Code and is often the most practical option. The agreement should be properly documented to reduce the risk of a later challenge.
