Guarantee of Payment for the Exporter in Uzbekistan

Abstract

Prepared within the International Private Law module at Tashkent State University of Law, this English-language study guide offers a comparative and critical analysis of the 1980 United Nations Convention on Contracts for the International Sale of Goods (CISG) and the legislation of Uzbekistan on securing payment to exporters. It reviews the remedies available to an unpaid Uzbek exporter under the CISG and under the Civil Code of Uzbekistan, concluding that the CISG provides a higher level of payment guarantee. The guide also examines letters of credit, demand guarantees and export credit insurance under Uzbek law, finding their practical application insufficient to serve as a strong guarantee for domestic exporters, and points out provisions of Uzbek legislation that should be cancelled or modified. Case study, comparative law and critical analysis methods are used. It is aimed at law and economics students and people involved in trade and logistics.
